Protecting your private information is our priority. This Statement of Privacy applies to the RefInsight.com and Ref Insight LLC and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Ref Insight LLC include Ref Insight.com and Ref Insight. The Ref Insight website is an e-commerce site. By using the Ref Insight website, you consent to the data practices described in this statement.

Please read this Privacy Policy carefully, since it governs your use of our (hereafter referred to as “we”, “us”, “our”, “Company” or “Ref Insight”) software, services, mobile application, website, and platform, which are cumulatively referred to in this Agreement as our “Site”. By using our Site, you acknowledge that you have read and understood all of the Terms of Service, and you agree to be bound by these Terms of Service.

Persons or businesses that decide to fully access all the features available through our Site are required to register as a “User” which allows them to participate in the use of our Site. The term “User,” “you”, and “your” means registered users, advertisers, businesses, or third-party service providers whether they are a person, company, business, or organization.

As a User you specifically agree to our Privacy Policy as well as our Terms of Service. You agree and accept our Privacy Policy as well as our Terms of Service all of which form a binding agreement (“Agreement”) between you and us.

Capitalized Terms not otherwise defined in our Privacy Policy have the meaning ascribed to them in our Terms of Service.

Collection of your Personal Information

Ref Insight may collect personally identifiable information, such as your name. We may gather additional personal or non-personal information in the future.
Information about your computer hardware and software may be automatically collected by Ref Insight. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of our Site.
Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Ref Insight's public message boards, this information may be collected and used by others.

Much of the information We obtain is from your device and includes:
  • Device operations: information about the activities performed on your device, such as windows open while using our Site, or mouse movements.
    Device attributes: information such as the operating system your device uses, hardware and software versions, battery level, signal strength, available storage space, browser type, application and file names and types, and device plugins.
  • Identifiers: unique identifiers, device IDs, and other identifiers, that may be available from games, apps or accounts you use, and family device IDs (or other identifiers unique to our products and services associated with the same device or account).
  • Device signals: Bluetooth signals, and information about nearby Wi-Fi access points, beacons, and cell towers.
  • Data from device settings: information you allow us to receive through your device settings that you turn on, such as access to your global positioning system (“GPS”) location, camera or photos. If you decide not to turn on your GPS location function in your device you may not be able to use all the features in our Site.
  • Network and connections: information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or that operate on your network. • Cookie data: data from cookies stored on your device, including cookie IDs and settings.

Ref Insight is not responsible for the privacy statements or other content on websites outside of our Site.

    Automatically Collected Information

    Whenever you interact with our Site, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of browser and/or device you’re using to access our Site, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features on our Site are visited and by how many people.     We may receive confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our Site and Services. For our statistical purposes, we gather details of user visits to our website and the information that users access, including, but not limited to, traffic data, location data, browser usage, page visits, weblogs, and other communication data. When you contact us, we may keep a record of that correspondence. We also use your information to ensure that content and the functionality of our Services and software are presented in the most effective manner for computer or mobile devices.

    From time to time, personal and business financial information (“Financial Information”) (including, but not limited to, banking information, credit card information, payment facilitator details, or other financial information) may be transmitted to facilitate transactions with Ref Insight and between Users. We will not share such Financial Information with third parties other than those third parties such as payment facilitators, banks, processing gateways, financial intermediaries, and merchant processors required to process and facilitate the sending and receiving of payments, and you understand that we cannot control how these third parties will use such Financial Information to perform their services to facilitate payments. Therefore, you hereby consent to such sharing of Financial Information. You agree to assume the risk and agree that it is your responsibility to properly handle, secure, not store and destroy such Financial Information as may be necessary to protect it from misuse. You hereby consent to such sharing of Financial Information and hold us harmless and indemnify us from any claims, breaches, loss, or damage resulting from the use of those payment facilitators, banks, processing gateways, financial intermediaries, and merchant processors we use. You agree we shall not be liable to you or any third party for misuse of such Financial Information.

    We may disclose information we collect from you to an affiliate or other third party in the event of any merger, sale, joint venture, assignment, reorganization, liquidation, transfer or other disposition of all or any portion of our business, assets, or stock.

    Ref Insight will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Ref Insight or the Site; (b) protect and defend the rights or property of Ref Insight; and, (c) act under exigent circumstances to protect the personal safety of users of Ref Insight, or the public.

    Online eCommerce Platform

    The Ref Insight Site is an e-commerce platform that allows us to provide the Services and make them available to you. Your information, including personal information, may be transmitted through, and stored on third-party servers in an encrypted format. We do not store your Financial Information and it is not processed on our servers. By using our Services, you consent to our collection, disclosure, storage, and use of your personal information in accordance with this Privacy Policy and our Terms of Service. You hereby consent to such sharing of Financial Information and hold us harmless and indemnify us from any claims, breaches, loss, or damage resulting from the use of the ecommerce platforms we use. You agree to assume the risk and agree that it is your responsibility to properly handle, secure, not store and destroy such Financial Information as may be necessary to protect it from misuse. You agree that we are not liable to you for misuse of such personal information or Financial Information. By using this Site, you agree to hold us harmless for any security breach and for any unauthorized use of your personal information or Financial Information by third parties. You also agree that we cannot be held responsible for any disclosure of your personal information or Financial Information through our Site without our knowledge and consent.

    Social Media, Posts, Texts, Forums and Profiles

    You agree that we may make available through our Site, third party sites or our Services certain forms of media either now existing or to be created in the future (for example, social media, message boards, chat functionality, videos, pictures, images, profile pages, text messaging and blogs) to which Users may be able to post information. Please note that any information Users provide on these various forms of media may become public and may be available to anyone who visits our Site, third party sites, and to the general public, including without limitation ratings and reviews. We urge you to exercise discretion and good manners when providing information of any type or kind and deciding to disclose any personal information. YOU AGREE THAT WE SHALL NOT BE RESPONSIBLE FOR ANY LOSS CAUSED BY THE USE BY US OR ANY UNAUTHORIZED PERSON OR ENTITY OF ANY INFORMATION THAT USERS DISCLOSE THROUGH OUR SITE, THIRD PARTY SITES OR THE USE OF THE SERVICES.

    California Online Privacy Protection Act Compliance

    As part of the California Online Privacy Protection Act, all users may make any changes to their information at any time by logging into their account and changing their information. We will not distribute their personal information to outside parties without their consent.     Use of Cookies

    The Ref Insight website uses “session” cookies, which last for the duration of your session on our website. Without these session cookies, the Services that you have asked for cannot be provided, and we only use these cookies to provide you with those Services.

Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

    One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize Ref Insight pages, or register with our Site or Services, a cookie helps Ref Insight to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Ref Insight Site, the information you previously provided can be retrieved, so you can easily use the Ref Insight features that you customized.

    Heat Map and Tracking Software

    We may use various types of tracking software (“Tracking Software”) to track mouse movement, scrolling, time spent on a page/screen, pages/screens visited, and clicks in order to better understand our users’ needs and to optimize the use of our Services. The most common form of Tracking Software is referred to as a “heat map” and the forms of heat maps include scroll maps, click maps, and movement maps. Heat maps are graphical representations of data where values are depicted by color. Users hereby specifically agree to our use of Tracking Software and heat maps.

    Our Tracking Software may capture screen shots of users’ mouse movements, scrolling, and clicking habits which helps us understand what users want, care about, and do when using our Services by visually representing their clicks, taps and scrolling behavior. Some of the reasons why we use heat map software are as follows: to see if Users are reaching important content or failing to see it, to find and use a page’s main links, buttons, opt-ins, and calls to action (“CTAs”), to see if Users are getting distracted by non-clickable elements, and to compare usage against mobile, tablet and desktop devices.

    We use Tracking Software to help us better understand our Users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what Users do and don’t like, etc.) and this enables us to build and maintain our Services with user feedback. This Traffic Software uses cookies and other technologies to collect data on our Users’ behavior and their devices. This includes a device's IP address (processed during your website visit and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our content. This Tracking Software stores this information on our behalf.

    Site and Application Analytics

    We use multiple web analytics tools provided by service partners, including but not limited to, Google Analytics to collect information about how you interact with our Site, including what pages you visit, what site you visited prior to visiting our Site, how much time you spend on each page, what operating system and web browser you use and network and IP information.

    Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Site and Services. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. We use the information provided by these tools to improve our Services. These tools place persistent cookies in your browser to identify you as a unique user the next time you visit our Site. Each cookie cannot be used by anyone other than the service provider (example: Google for Google Analytics). The information collected from the cookie may be transmitted to and stored by these service partners on servers in a country other than the country in which you reside. Though information collected does not include personal data such as name, address, billing information, etc., the information collected is used and shared by these service providers in accordance with their individual privacy policies. You can control the technologies we use by utilizing settings in your browser or third-party tools. You can opt-out of making your activity available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.     Targeted Advertisements

    Ref Insight does not use cookies related to targeted advertising. Our third-party partners may use technologies such as cookies to gather information about such activities in order to provide you with advertising based upon your browsing activities and interests, and to measure advertising effectiveness.     Security Not Guaranteed

    We use reasonable organizational, technical, and administrative measures to protect each User’s personal information under our control. However, we cannot guarantee 100% percent protection and security of such personal information. Please do not email or text us credit card information and/or other sensitive information.

    Children Under Thirteen

    Ref Insight collects personally identifiable information from children under the age of thirteen. Ref Insight collects this information for the following reason(s):

    Specific sporting events that utilize the services of minors and children under the age of 13 as on-field officials.

    By using this Site, you represent, acknowledge, and agree that if you are under the age of thirteen (13) years of age (a “Minor”), that you are using the Site with the consent of your parent or legal guardian and that you have received your parent’s or legal guardian’s permission to use the Site and agree to its Terms. If you are a parent or legal guardian of a Minor, you hereby agree to bind the Minor to these Terms and to fully indemnify and hold harmless the Company if the Minor breaches any of these Terms. A parent or guardian email address must be stored within your Ref Insight profile for all electronic communication to be copied to if you are under thirteen (13) years of age. If you are a parent or guardian and you have questions regarding our data collection practices, please contact us using the information provided at the end of this Agreement.

    Children Under Eighteen

    By using this Site, you represent, acknowledge, and agree that if you are under eighteen (18) years of age but are at least 13 years old (a “Minor”), that you are using the Site with the consent of your parent of legal guardian and that you have received your parent’s or legal guardian’s permission to use the Site and agree to its Terms. If you are a parent or legal guardian of a Minor, you hereby agree to bind the Minor to these Terms and to fully indemnify and hold harmless the Company if the Minor breaches any of these Terms. A parent or guardian email address must be stored within your Ref Insight profile for all electronic communication to be copied to if you are under eighteen (18) years of age. If you are a parent or guardian and you have questions regarding our data collection practices, please contact us using the information provided at the end of this Agreement.

    Opt-Out & Unsubscribe

    We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information.

    Changes to this Privacy Policy

    Ref Insight will occasionally update this Privacy Policy to reflect Company and User feedback which will be done by changing the “Last Updated” date appearing at the top of this Privacy Policy. Ref Insight encourages you to periodically review this Privacy Policy to be informed of how Ref Insight is protecting your information.
